In New Jersey, real estate licensees are required to disclose how they intend to work with buyers and sellers in a real estate transaction. IF you are looking to BUY a property, I will represent you as a BUYER'S AGENT AND DISCLOSED DUAL AGENT IF THE OPPORTUNITY ARISES. What does that mean ? As a BUYER'S AGENT I will represent you, and all MATERIAL information supplied to me by you will be told to the Seller. CONFIDENTIAL information you supply to me shall REAMAIN confidential. If I am showing you properties owned by Sellers for who Hager Real Estate, Inc. has the listing, I becone a DISCLOSED DUAL AGENT. When we meet I will have you sign a Consumer Information Statement, which I also sign, that acknowledges that you approve of the Agency we enter into. It is NOT a commitment that you must buy from ME. As a DISCLOSED DUAL AGENT I have fiduciary obligations to BOTH the Buyer and Seller. I MUST have the express permission of a oparty prior to disclosing CONFIDENTIAL Information. Such information includes the highest price a BUYER will pay and the lowest price a SELLER will accept and the parties motivation to buy or sell. Generally these issues resolve themselves throught the offer/counter offer/acceptance stage.
